EPO to abolish the 10 day rule
Up to the present, rule 126(2) of the European Patent Convention stipulated that notification from the EPO is considered to occur 10 days after the date on which the notification was sent.
A few days ago, the Administrative Council passed a package that aims to adapt the rules of the EPC to the digital age, and abolishment takes place among them.
Even though it is confirmed, the new rule will come into force on 1st November 2023.
